Maybe a red eared slider, or a russian tortoise.

A RES would outgrow a 40 gallon in a couple of years if not sooner.

But a baby would fit nicely, for the time being

Thats the exact kind of mentality that ends up with red eared sliders as the second most commonly dumped reptile pet. All too often, people aren't prepared to have a large pond setup for an adult and just get rid of it when it gets too big instead of going to the expense of resetting it up properly.

As far as aquatic stuff, common musk turtles, razorback musk turtles, or one of the various mud turtle species would do just fine in that size tank. A painted turtle or map turtle would probably be ok as well, depending on which species - some get larger than others. For land turtles, most species of box turtles would be fine with that much space. A Russian tortoise, Herman's tortoise, Egyptian tortoise, or Greek tortoise would all do ok - but they generally like to wander, so more space is better. As always though, a lot more research into proper set up is necessary. Every species has different needs aside from just enough space.

    Thus "for the time being"
One would obviously need to get a bigger tank after a few years.

A Russian would definitely need more room than a 40 gallon, unless you got a hatchling. They would eventually out grow it though.

Most aquatic turtles need a cage with a length 6x their body and a with 3x their body length minum. Terrestrial turtles need at least 4sq feet per 8 inches of turtles. Large tortoises need a mininum of 4sq yards per foor of tort. Smaller torts need more room somrthing like 1.5sq feet per 2 inches of tort. These are all minum sizes bigger is always better.
